Welcome to SniffOut. These Terms of Service ("Terms") govern your access to and use of the SniffOut mobile application. By creating an account or using SniffOut, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app.
By accessing or using SniffOut, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. These documents together form a legally binding agreement between you and SniffOut.
You must be at least 13 years old to use SniffOut. If you are between 13 and 18, you must have obtained parental or guardian consent. By using the app, you represent that you meet these requirements.
You agree to provide accurate, current, and complete information during registration, keep your password confidential, notify us of any unauthorized use of your account, and be responsible for all activities that occur under your account. You may not create more than one account or create an account if you have been previously banned.
You retain ownership of all content you post on SniffOut. By posting content, you grant SniffOut a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely for the purpose of operating SniffOut. You represent that you own or have the right to post your content and that it complies with these Terms and all applicable laws.
You agree not to post or engage in:
Reviews must be based on genuine, firsthand experiences. You may only review users you are friends with or have attended a walk with. False, defamatory, or malicious reviews are prohibited. SniffOut reserves the right to remove any review at its sole discretion.
Core features of SniffOut are free. We may offer optional premium features for a fee. All payments are processed through Apple In-App Purchases or Google Play Billing. Subscriptions auto-renew unless cancelled through your App Store or Google Play account. No refunds are provided for unused portions of a subscription period, except where required by law. Sponsored content from local pet businesses will be clearly labeled.
SniffOut facilitates connections but is not responsible for what happens when users meet in person. Always meet in public places, inform someone of your plans, and trust your instincts. SniffOut expressly disclaims any liability for harm resulting from in-person meetings arranged through the app.
SniffOut and its original content, features, functionality, design, logos, and trademarks are owned by SniffOut and protected by intellectual property laws. You may not copy, modify, or distribute any part of our app without written permission.
SniffOut is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free or uninterrupted. We are not responsible for the accuracy of user-generated content, including park busy status, reviews, or park insights.
To the fullest extent permitted by law, SniffOut shall not be liable for any indirect, incidental, special, or consequential damages. In no event shall our total liability exceed the greater of the amount you paid to SniffOut in the 12 months preceding the claim, or $100 USD.
You agree to indemnify and hold harmless SniffOut and its officers, directors, employees, and agents from any claims arising from your use of SniffOut, your User Content, your violation of these Terms, or any in-person meeting arranged through the app.
These Terms are governed by the laws of the State of New York. Any disputes shall first be attempted to be resolved through good-faith negotiation, then submitted to binding arbitration in New York, NY. You agree that disputes will be resolved on an individual basis, not as a class action.
If you download SniffOut through the Apple App Store, these Terms are between you and SniffOut only, not Apple. Apple has no obligation to provide maintenance or support for SniffOut. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms.
We may suspend or terminate your account at any time for violations of these Terms. You may delete your account by contacting support@sniffoutapp.com. Upon termination, your right to use SniffOut ceases immediately.
We may modify these Terms at any time. We will provide notice of material changes through the app or by email. Continued use of SniffOut after changes take effect constitutes acceptance.
